Privacy Policy
Welcome to Tracon Handels GmbH. The following privacy policy provides you with a simple overview of what happens to your personal data when you visit our website www.tracon.ch. This policy is intended to inform users of our website about the nature, scope and purpose of the collection and use of personal data by us in accordance with the Swiss Federal Act on Data Protection (“nFADP”) and the EU General Data Protection Regulation (“GDPR”).
Who is responsible for data processing?
A “data controller” is a person or organisation that, alone or jointly with others, determines the purposes and means of the processing of personal data. In this sense, Tracon Handels GmbH, Brügglistrasse 11b, 8852 Altendorf (“Tracon”, “we”, “us” or “our”) is the data controller. If you have any general questions about data protection at Tracon, you can contact us at info@tracon.ch or write to us at the address stated above.
What is personal data?
Personal data is any information relating to an identified or identifiable living person. Different pieces of information that, when combined, can lead to the identification of a specific person also constitute personal data.
What legal bases exist for processing your data?
Below, we inform you about the legal basis on which we process your data. Unless the legal basis is expressly stated, the following applies:
Consent: This applies when we have asked you for your explicit consent to process your data for a specific purpose.
Contract: In this case, we process your data in order to fulfil a contractual agreement that we have entered into with you.
Legitimate interests: In this case, we rely on our interests as the reason for processing. In general, this means providing you with the best services in the safest and most appropriate way. Before relying on any of these legitimate interests, we naturally weigh them against your interests and ensure that they are sufficiently compelling and will not cause unjustified harm.
Legal obligation: This applies when we are legally or otherwise required to process the data, for example to investigate criminal offences.
What personal data do we collect from you?
We may collect and process the following personal data about you:
a) Personal data that you provide to us:
This is information about you that you provide to us. This includes, for example, your name, your email address and your phone number when you contact us or request services. The legal basis is the initiation of a contract with you and your consent.
We also offer you the option of contacting us via the messaging services of
WhatsApp (WhatsApp LLC, 1601 Willow Road, Menlo Park, California 94025, USA). If you contact us via WhatsApp, we store and use the mobile phone number you use and, if provided, your first and last name in accordance with the performance of a contractual or pre-contractual measure in order to process and respond to your enquiry.
b) Personal data that our website collects about you:
When you visit our website, certain information about you and your visit is collected automatically, including the Internet Protocol address (IP address) with which your device is connected to the Internet and other information, such as the pages you visit on our website. This information is used to monitor the performance of the website and improve the experience of visitors to the website. The legal basis is the initiation of a contract with you and our legitimate interest.
c) Cookies:
We use cookies on our website. As specified in the nFADP and the EU Privacy and Electronic Communications Directive (“PECD”), we must obtain your consent for the use of non-essential cookies. The legal basis for the use of cookies is our legitimate interest and your consent. Further information on the cookies we use can be found in our cookie policy.
d) Processing by third-party services:
We use the hosting services of Webland (Webland AG, Kaspar Pfeiffer-Strasse 4, 4142 Münchenstein, Switzerland) to host and display our website. Webland does this on the basis of processing on our behalf, which also means that all data collected on our website is processed on Webland’s servers. The basis for the processing is our legitimate interest as well as the initiation and/or fulfilment of a contract.
For optimal data management and customer support, we store the data relating to your communication and your contract with us in our company’s own management system, which is supported by Microsoft 365 (1 Microsoft Way, Redmond, WA 98052, USA and Walter-Gropius-Strasse 5, 80807 Munich, Germany) and Google Workspace (Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, US, and Google Ireland Limited Gordon House, Barrow Street, Dublin 4, Ireland). This data processing is based on our legitimate interest in providing our customer service.
We also use reCAPTCHA from Google to verify whether data is entered by a human being or by an automated program. For this purpose, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. The legal basis for the use of reCAPTCHA is our legitimate interest.
Our website uses the Google Maps API to display geographical information visually. When Google Maps is used, Google also collects, processes and uses data about visitors’ use of the map functions (for more information about data processing by Google, please refer to Google’s privacy policy). The integration of Google Maps constitutes a legitimate interest.
How will we use your personal data?
We may collect, store and use your personal data for the following purposes:
- – to operate, manage, develop and promote our business, in particular our relationship with you and the related transactions, such as:
- – marketing purposes (if we have either obtained prior consent and/or have a legitimate interest in sending you communications that we consider relevant and useful to you);
- – accounting and billing/payment purposes;
- – for the operation, administration and improvement of our website and other aspects of our business operations;
- – to provide you with our website and services;
- – to provide you with services or information that you have requested; and
- – to inform you about relevant topics or services that may be of interest to you and keep you up to date.
- – to protect our company against fraud, money laundering, breach of trust, theft of protected material and other financial or business crimes;
- – to comply with our legal and regulatory obligations, to assert and defend legal claims and to enforce legal claims; and
- – where the purpose is directly connected with an assigned purpose previously communicated to you.
We will process your personal data only where this is necessary for us to pursue the purposes described above and where we have a legal basis for such processing. Where our legal basis for processing is that such processing is necessary for the pursuit of our legitimate interests, we will process your personal data only if we have concluded that our processing does not affect you or your privacy in a way that would override our legitimate interest. In exceptional cases, we may also be legally required to disclose or otherwise process your personal data.
Change of purpose
We will use your personal data only for the purposes for which we collected it as described above, unless we believe that we need to use it for another purpose and that reason is compatible with the original purpose. If we need to use your personal data for another purpose, we will inform you and explain the legal basis that allows us to do so.
Storage and retention
Your personal data will remain with us until the purpose for processing the data no longer applies. If you make a legitimate request for erasure or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible grounds for storing your personal data (e.g. tax or commercial-law retention periods); in the latter case, the data will be deleted as soon as these grounds no longer apply.
When do we share your personal data?
We may share your data with organisations that help us provide the services described in this policy and that are permitted to process this data on our behalf and in accordance with this policy in order to support our website and our services. If you would like to learn more about how the respective provider processes your personal data, please follow the links embedded in the names of the providers listed above.
As a rule, and unless otherwise stated in this policy, data may be shared on the basis of our contractual and pre-contractual obligations. Likewise, data may be shared if you have consented, if we are legally obliged to do so, or on the basis of our legitimate interests (e.g. when using agents, hosting providers, tax, corporate and legal advisers, accountants and similar services that enable us to fulfil our contractual obligations, administrative tasks and duties efficiently and effectively). This also applies where we commission third parties to process data on the basis of a so-called “processing agreement”.
We may also disclose information in other circumstances, for example if you agree to this or if the law, a court order, a legal obligation or a supervisory authority requires us to do so. This also applies if the purpose is to prevent fraud or crime, or if it is necessary to protect and defend our rights, our property or the personal safety of our employees, the website and its users.
Marketing
If you have given us your consent to process your personal data for marketing and advertising purposes, we are entitled to contact you for these purposes via the communication channels to which you have given your consent. Our marketing is usually carried out by email, but may also include other, less traditional or new channels. These forms of contact are managed by us or by service providers commissioned by us. Any directly addressed marketing sent by us or on our behalf includes a means by which you can unsubscribe or opt out.
How we protect your personal data
For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the website operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the browser’s address line changing from “http://” to “https://” and by the lock symbol in your browser line. If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Linked sites
For your convenience, our website may contain hyperlinks to other websites. We are not responsible for the privacy practices of linked websites or of companies that we do not own or control, and this privacy policy does not apply to them. The links on the website may collect additional information in addition to the information collected by us.
We do not endorse any of these linked websites, their products, services or the content on their websites. We recommend that you read the privacy policies of every linked website that you visit in order to understand how the information collected about you is used and protected.
Social media
We are present on social media on the basis of our legitimate interest. If you contact us or connect with us via social media, we and the relevant social media platform are jointly responsible for the processing of your data and enter into a so-called joint controllership agreement. The personal data collected when you contact us is used to process your enquiry, and the bases for this are both your consent and our legitimate interest.
Data breaches and notification
Databases or data records containing personal data may be breached accidentally or through unlawful intrusion. As soon as we become aware of a data breach, we will notify all affected persons whose personal data may have been compromised, and the notification will be accompanied by a description of the measures taken to remedy the damage caused by the data breach. Notifications will be sent as quickly as possible after the breach is discovered.
